Privacy policy

Lenk-Simmental Tourismus AG ("LST") informs you with this privacy policy about the collection of personal data during your visit to the LST website. By accessing the LST website, you agree to this privacy policy. Please note that certain updates to this privacy policy may become necessary in the course of content and technical developments of this website as well as new legal provisions. We therefore recommend that you read this privacy policy again from time to time.

Definition of "personal data"

"Personal data" means any information relating to an identified or identifiable natural person ("data subject"). An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

As a visitor to the LST website, personal data is all data that can be related to you personally, e.g. name, address, email address or user behaviour.

Type, scope and purpose of use of personal data

We process your personal data for the following purposes:
- Presentation and technical and content optimisation of our website
- Newsletter registration
- Data security and website security
- Creation of usage statistics
- Marketing purposes

Presentation of the website

When you visit the LST website, our servers automatically and temporarily store the following data

- the IP address of the requesting computer
- the date and time of access
- the name and URL of the retrieved file
- the website from which the access was made
- the operating system of your computer and the browser used
- the country from which access was made and the language settings of the respective web browser
- the name of the Internet access provider

When visiting the LST website, the user gives his conclusive consent to the temporary storage of the IP address of his terminal device (cf. Art. 6 para. 1 lit. a GDPR). This data is stored and processed for a short period of time to enable the use of the LST website (connection establishment), to ensure system security and stability in the long term, to optimise our website and to keep internal statistics. The data is deleted as soon as it is no longer required to fulfil these purposes. Further data processing or personal evaluations do not take place, except in connection with technical security incidents, behaviour in breach of contract or criminal offences.

Posts and comments

If you leave a post or comment on this website, your IP address will be saved. This is done on the basis of our legitimate interests within the meaning of Art. 6 para. 1 lit. f. GDPR and serves the security of us as the website operator: Because if your comment violates applicable law, we can be prosecuted for it, which is why we have an interest in the identity of the author of the comment or contribution.

Signing up for our newsletter

You have the option of subscribing to our newsletter on our website. This requires registration with the following data:

- Email address
- Optional: title, first and last name, postcode, city, gender

This data is required in order to personalise the information and offers sent to you and to better tailor them to your interests. By registering, you authorise the processing of the data provided for the regular sending of our newsletter to the e-mail address you have provided. LST also uses this data for the statistical analysis of user behaviour and to optimise the newsletter. This consent constitutes our legal basis for the processing of your e-mail address within the meaning of Art. 6 para. 1 lit. a GDPR.

We use third-party email marketing services to send our newsletter. Our newsletter may therefore contain a so-called web beacon (tracking pixel) or similar technical means. A web beacon is a 1×1 pixel, invisible graphic that is associated with the user ID of the respective newsletter subscriber. The use of corresponding services allows us to analyse whether the emails containing our newsletter have been opened. In addition, the click behaviour of recipients can also be recorded and evaluated. We use this data for statistical purposes and to optimise the newsletter in terms of content and structure. This enables us to better tailor the information and offers in the newsletter to the individual interests of each recipient. The tracking pixel is deleted when you delete the newsletter. To prevent tracking pixels in our newsletter, please set your mail programme so that no HTML is displayed in messages.

You can unsubscribe at any time using the link at the end of each newsletter. In this context, you can optionally inform us of the reason for unsubscribing. Your personal data will then be deleted. Further processing will only take place in anonymised form to optimise our newsletter.

Registration for our image database

A selection of images can be obtained from the database on our website. In principle, no personal account is required for this. However, we recommend that you register, especially if you visit the site frequently. We need the following information from you:

- E-mail address
- Password you have chosen

Booking, ordering or reservation with third parties

LST arranges accommodation such as hotels, holiday flats and holiday homes as well as additional services and tickets from third-party providers. Please also read our booking conditions.

Offers can be booked or reserved in various ways on our website and information material or other services can be ordered. The corresponding services are provided by third parties. Customers are informed on the relevant subpages that they are being forwarded to our partners. Depending on the service, various personal data is collected, such as

- Salutation and/or company
- First name and surname
- Address (street, house number, postcode, town, country)
- Date of birth or age
- Other contact details (e-mail address, telephone number)
- Language
- Data of fellow travellers
- Credit card details, if applicable

Without the information marked as necessary, the booking services may not function optimally. The personal data you enter is normally collected directly by the partner concerned or, in the case of certain offers, forwarded to them by us. Only the personal data required to fulfil the service in question will be passed on. In these cases, the data protection provisions of the respective partner apply to further processing, over which LST has no influence and therefore rejects any liability. The legal basis for this is the fulfilment of a contract within the meaning of Art. 6 para. 1 lit. b GDPR.

Participation in competitions

When participating in competitions offered on this website, personal data, namely title, first name, surname, address, postcode/city, telephone number and email address, are collected. This data is required for the implementation of the competition, in particular for the assignment of the participation applications to the respective participants and for the determination and notification of the winners - in accordance with the competition conditions and Art. 6 para. 1 lit. b GDPR for the fulfilment of the contract. By participating in the competition, the user gives his/her conclusive consent (see Art. 6 para. 1 lit. a GDPR) that the personal data entered may be stored by Lenk-Simmental Tourismus AG and used for the organisation of the competition in question and for the determination and notification of the winners. The personal data received will only be processed and used by Lenk-Simmental Tourismus AG to the extent that it is necessary for the realisation of the competition. The personal data of the respective participant will be stored for the duration of the competition or for a maximum of three years and then deleted.

Webcams

The service providers of the destination Lenk-Simmental have installed a webcam at various locations. The purpose of these webcams (cameras) is to provide images of the current conditions on site. The live stream can be found on the LST website and thus on the public internet. The webcams are positioned so high up that it is almost impossible to identify individuals. In addition, the webcams only show live images. This means that these images and data are not stored and/or processed at any time. This data processing is carried out in accordance with Art. 6 para. 1 lit. e GDPR for the performance of a task carried out in the public interest.

Personalised marketing

We use social media plugins (interfaces to social networks) and pixels on our website to display personalised advertising and to use web analysis services. You can find more information on this below. We offer personalised services and information on our website (on-site targeting). To this end, we collect, use and analyse the data when you visit the LST website, which may also involve the use of so-called "cookies" (see below). The analysis of your user behaviour can also lead to the creation of a so-called user profile. However, the data will only be merged using a pseudonym.

Pixel tourism promotion project
As part of a tourism promotion project, we use a tracking pixel on our website / app that is provided by a Swiss tourism provider ("third-party provider"). A tracking pixel is a small image file that measures how many people visit our website/app and how they interact with our offers.

Among other things, the tracking pixel records your IP address, device ID, operating system, browser type, the URL accessed and the content with which you interact. This data is sent to the database of the third-party provider, where it is analysed and, if necessary, enriched with further data such as survey results. The data collected is anonymised by the third-party provider as early as possible.

The findings from the tracking are made available to us by the third-party provider in aggregated form. It is not possible for us to re-identify the people tracked. The findings are used to increase the attractiveness of the entire tourism region, improve our offers and optimise the user-friendliness of our website / app.

You can prevent tracking via the pixel by disabling tracking in your browser settings or restricting the loading of images. However, the latter will affect the app or website display.

Passing on data to third parties

We only pass on your personal data if you have expressly consented to this, if there is a legal obligation to do so or if this is necessary to enforce our rights - in particular to enforce claims arising from the relationship between you and LST. In addition, we pass on your data to third parties insofar as this is necessary for the use of the website, for the provision of the services you have requested and for the analysis of your user behaviour.

Transfer of personal data abroad

LST is authorised to transfer your personal data to third-party companies (contracted service providers) abroad if this is necessary for the data processing described in this privacy policy. These companies are obliged to protect data to the same extent as we are. If the level of data protection in a country is lower than in Switzerland or the EU, we contractually ensure that the protection of your personal data corresponds to that in Switzerland or the EU at all times.

Data security

Please note that contact with LST and its partners - for example by registering for the newsletter or using the image database - takes place via the Internet and is therefore an open network accessible to everyone. Although the data between you and the LST website is transmitted in encrypted form, certain transport connection data such as the sender and recipient addresses remain unencrypted.

We use appropriate technical and organisational security measures to protect your personal data stored by us against manipulation, partial or complete loss and against unauthorised access by third parties. These measures are constantly being improved in line with technological developments. Nevertheless, you should always treat your access data for accounts and payment information confidentially and close the browser window when you have finished communicating with us - especially if you share your computer with others. The appropriate protection of your computer and devices is your responsibility.

We also take data protection within the company very seriously. Our employees and the service companies commissioned by us have been sworn to secrecy and to comply with data protection regulations.

Furthermore, LST is not liable for loss of profit, loss of data or other direct, indirect or consequential damage resulting from access to elements of the LST website or their use or the inability to access or use them or from links to other websites or from technical faults.

Storage of personal data

We only store personal data for as long as is necessary
- to use the above-mentioned tracking, advertising and analysis services within the scope of our legitimate interest
- to carry out services that you have requested or for which you have given your consent (e.g. for the newsletter) to the extent specified above
- to fulfil our legal obligations.

Contract data will be stored by us for longer as this is required by statutory retention obligations. The latter result from accounting and tax law regulations. These require that business communication, concluded contracts and accounting documents must be kept for up to 10 years or, in the case of users resident in France, for up to 5 years. If we no longer need this data to perform the services for you, the data will be blocked. This means that the data may then only be used for accounting and tax purposes.
